TERMS OF SERVICE

These Terms of Service ("Terms") govern your access to and use of The Ink System, an AI tattoo design app and website (together, the "Service") operated by Shordy Forge LLC ("we," "us," "our"). By using the Service you agree to these Terms and our Privacy Policy at theinksystem.com/privacy. If you do not agree, do not use the Service.
1. ELIGIBILITY
You must be at least 13 years old, or the minimum age of digital consent in your country, whichever is higher. If you are under 18, you must have a parent or guardian's permission. You confirm you have the legal right to enter into this agreement.
2. YOUR ACCOUNT

You provide a valid email address and a secure password.
•
You are responsible for everything that happens under your account. Keep your password private.
•
Tell us right away at hello@theinksystem.com if you suspect unauthorized access.
•
We may refuse, suspend, or terminate accounts that violate these Terms.
3. THE FREE TIER AND SUBSCRIPTIONS
•
Free tier — new accounts receive a limited number of free generations (currently 3). Visitors without an account may try a limited guest preview. Free-tier designs are saved to your gallery like any other.
•
Pro subscriptions — we offer auto-renewing subscription plans (currently weekly, monthly, 6-month, and annual options). Each plan includes the generation allowance described on the pricing screen. Current prices are always shown in the app at the time of purchase and may change with notice. Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date.
•
Billing — processed by Stripe (web), Apple (iOS), or Google (Android). You agree to the applicable platform's billing terms. We do not store your full payment details.
•
Cancellation — cancel at any time from the Manage Subscription option in the app (web), or via Apple / Google subscription settings (mobile). Cancellation takes effect at the end of your current billing period; you retain access until then. We do not automatically refund the unused portion of a period.
•
Refunds — we offer refunds in line with applicable consumer-protection law. For iOS, refunds are processed by Apple (reportaproblem.apple.com). For Android, by Google Play. For web, email hello@theinksystem.com within 14 days of purchase and we will consider your request in good faith.
4. WHAT YOU CAN DO WITH GENERATED DESIGNS

Your designs are yours — you own the output the Service generates for you. You can print them, show them to an artist, get them tattooed, or share them on social media.
•
Our license to display your work — you grant us a non-exclusive, worldwide, royalty-free license to store, display, and process your designs as necessary to operate the Service (e.g. show them in your gallery, back them up, deliver them on the web).
•
Promotional use — we may show anonymized, non-attributed examples of generated designs in marketing, unless you opt out by emailing hello@theinksystem.com. If you opt out, your designs will never be used in marketing.
•
AI output limitations — the Service generates designs based on your prompts and the underlying model's training data. We do not guarantee uniqueness, and two users with similar prompts may receive similar designs. We make no warranty that any generated design is free of resemblance to pre-existing work. You are responsible for ensuring your final tattoo does not infringe the rights of any third party.
5. ACCEPTABLE USE
You agree not to use the Service to generate, distribute, or upload content that:

Is sexually explicit or depicts minors in any sexualized way.
•
Promotes violence, self-harm, terrorism, or hatred toward any protected group.
•
Infringes another person's intellectual property rights.
•
Includes the likeness of an identifiable real person without their consent.
•
Attempts to jailbreak, reverse-engineer, or bypass safety filters.
•
Violates applicable law.
We may block prompts that trigger our safety filters, remove content that violates these Terms, and suspend accounts that repeatedly violate them.
6. TATTOOS, YOUR BODY, AND YOUR ARTIST
•
The Service is a design tool, not a tattooing service. We do not apply tattoos. We do not verify that any design is medically, anatomically, or culturally appropriate for your body or situation.
•
Consult a licensed tattoo artist before getting any design inked. The artist is the professional responsible for ensuring the design is tattooable at the requested size and placement.
•
Certain cultural, religious, and sacred symbols may have meaning we cannot detect. Use your own judgment and, where appropriate, consult someone from that community before getting a tattoo.
•
We do not guarantee that your tattoo artist will agree to reproduce a given design.
7. INTELLECTUAL PROPERTY — OUR STUFF
The Service itself — the app, website, brand name "The Ink System," logos, UI, code, and trained assets — is our property or licensed to us. Do not copy, resell, or create a competing product from our content.
8. THIRD-PARTY SERVICES
The Service uses third-party providers (listed in our Privacy Policy). Your use of those providers, where surfaced (e.g. Apple / Google payment), is also governed by their terms. We are not responsible for third-party outages or errors.
9. WARRANTY DISCLAIMER
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SAFE, OR THAT ANY SPECIFIC DESIGN WILL BE TATTOOABLE.
10. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) $50 USD. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR REGRET OVER A TATTOO.
Some jurisdictions do not allow these limitations; in those cases our liability is limited to the minimum permitted by law.
11. INDEMNIFICATION
You agree to indemnify and hold Shordy Forge LLC harmless from any claim arising from (a) content you generate or upload, (b) your violation of these Terms, or (c) your violation of another person's rights.
12. TERMINATION
You may stop using the Service at any time and request account deletion by emailing hello@theinksystem.com. We may suspend or terminate your access if you violate these Terms, if required by law, or if we discontinue the Service. On termination, the license you granted us to display your work ends, except where we already have obligations (e.g. backups, legal retention).
13. CHANGES
We may update these Terms. Material changes will be announced in the app and by email at least 14 days before taking effect for existing users. Continued use after the effective date means you accept the updated Terms.
14. GOVERNING LAW AND DISPUTES
These Terms are governed by the laws of the State of Wisconsin, United States, without regard to conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Wisconsin, and you consent to that jurisdiction.
EU consumers: nothing in these Terms deprives you of protections under mandatory consumer law in your country of residence.
